These Terms & Conditions (“Terms”) govern your use of the ExpDater web application (exp.bryerstone.com) and related services (collectively, the “Service”) operated by MSTARDOM, INC (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms.

1. Eligibility & Account Registration

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service. When you create an account, you agree to provide accurate and complete information and to keep your login credentials secure. You are responsible for all activity that occurs under your account.

2. Description of the Service

ExpDater is an expiration-date reminder service that allows you to store information about documents, licenses, contracts, inventories, and other time-sensitive items, and to receive reminders by email and/or SMS as configured in your account.

We may update, modify, or discontinue features of the Service at any time, with or without notice, consistent with maintaining a reliable and secure platform.

3. Subscriptions, Billing & Payments

Some features of the Service may be offered on a paid subscription basis. If you sign up for a paid plan, you authorize us and our payment processor to charge the applicable fees to your chosen payment method on a recurring basis, as described at the time of purchase.

You are responsible for keeping your payment information up to date. If a payment fails, we may suspend or downgrade your account until payment is successfully processed.

Any refunds, cancellation terms, or trial periods will be described at checkout or in your billing settings. To the maximum extent permitted by law, fees are non-refundable except as expressly stated.

4. Acceptable Use

You agree not to use the Service for any unlawful, harmful, or abusive purpose, including but not limited to:

We reserve the right to suspend or terminate accounts that violate these Terms or that generate abuse complaints with carriers or messaging providers.

5. SMS Terms

If you enable SMS notifications, you agree to receive text messages from ExpDater related to your account and your configured expiration dates.

SMS delivery may be subject to the capabilities and coverage of your wireless carrier. We are not liable for delays or failures in message delivery outside our reasonable control.

6. Your Content

You retain any rights you have in the content and data you upload to the Service. By using the Service, you grant us a limited, non-exclusive license to store, process, and use that content solely for the purpose of providing and improving the Service.

You represent and warrant that you have all necessary rights to upload and store the content you submit to ExpDater and that such content does not violate any law or the rights of any third party.

7. Intellectual Property

The Service, including its software, design, and branding (excluding your own content), is owned by MSTARDOM, INC and/or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service except as expressly allowed by these Terms or applicable law.

8. Termination

You may stop using the Service at any time and may request account closure. We may suspend or terminate your access to the Service if you materially breach these Terms, create security risk, or use the Service in a way that could harm us, other users, or third parties.

Upon termination, we may retain or delete your data consistent with our Privacy Policy and any legal obligations.

9. Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that reminders will always be sent or delivered on time, or that the Service will be free from interruptions or errors.

10. Limitation of Liability

To the maximum extent permitted by law, MSTARDOM, INC and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.

11. Governing Law

These Terms will be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws rules. Any disputes arising under these Terms will be resolved in the state or federal courts located in New York, USA, where permitted by law.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. If changes are material, we may provide additional notice within the Service. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
